Democrats in both the House and the Senate have created a new Dignity for Detained Immigrants Act. In this bill it lists a number of minimum standards that must be met to detain illegal immigrants and time periods that must be kept. The sponsors of the bills are Rep Pramila Jayapal, D-Wash. and Sen. Cory Brooker, D-NY.
According to the bill, officials would have 48 hours to decide if an alien being released would mean that the alien will not appear as required for a future court date, or if there is a possible safety issue. If those issues are a possible problem the DHS “shall impose the least restrictive conditions” for detention and ensure a custody hearing within 72 hours. During those hearings, there must be the “presumption” the alien should be released.
With the current number of immigrants that are at the border, not sure how those time frames will be able to work.
However, this next part is probably where the problem would be resolved. There will be a “special rule for vulnerable persons and primary caregivers” that may not be detained unless the DHS can prove these persons are not able to be placed in a community-based supervision program. These “vulnerable persons are; anyone under the age of 21 or older than 60, pregnant, or identifies as a part of the LBGTQ+ communities, a witness to a crime or is a victim of a crime, filed a nonfrivolous civil rights claim in court, anyone with a workplace claim, and those that have a serious mental or physical illness or disability. So in a nutshell, anyone that comes to the border.
Let’s face it, these Democrats really have no idea what National Security means. They live in a fantasy world where they must think a straight person who wants to destroy the country, say a terrorist won’t suddenly at the border become an LGBTQ+ community member, claim some type of mental illness, or be over 60 or under 21. This isn’t even mentioning the fact that a gay person from another country can also be a terrorist or simply a criminal too.
While none of what I just mentioned makes sense to people with common sense and understand that criminals will do what is needed to get around laws and barriers, there is more to the exemption list.
If aliens with a credible fear of persecution, limited English language proficiency, have experienced severe trauma, or have been survivors of torture or gender-based violence also in the “vulnerable person” definition. Just how are you going to know if any of these things are credible fears or really good actors or both? Drug cartels and coyotes both use fear and abuse on their victims as they cross the border. Young children and women are often raped and forced to commit crimes with the threat of a loved one back home having the same done to them if a crime isn’t completed. And as for the limited English language proficiency goes, well duh most of them won’t know the English language because they come from other countries with different languages.
They say this is all to restore humanity and dignity to the immigration system. If you want real humanity and dignity in the system, then close the border and force every immigrant to use the proper and legal method of entry to the US. Stop allowing criminals to abuse, rape, and threaten women and children to smuggle drugs, weapons, and other criminal activities. Stop allowing coyotes from dragging people through a hot desert with no food or water or in a semi-trailer to bake and then die in the middle of nowhere.
